Align Technology moves to block Angelalign clear aligner imports

announced that it filed a complaint seeking to block the import of Angelalign clear aligners.

The maker of Invisalign clear aligners and other dental technology filed a complaint under Section 337 of the Tariff Act (which prohibits unfair competition and acts in the importation and/or sale of goods) with the U.S. International Trade Commission (ITC). It alleges the unauthorized importation and sale of clear aligners that infringe Align’s patents.

Align’s latest move in this ongoing battle with China-based Angelalign follows the filing of patent infringement lawsuits last month. The lawsuits allege that Angelalign’s products and associated software infringe Align patents. These patents encompass innovations like multilayer aligner materials, cutting-edge treatment planning and advanced aligner features. Align initiated its legal actions in the U.S., Europe and China. It seeks both injunctive relief and monetary damages through its intellectual property enforcement efforts.

The complaint with the ITC alleges that Angelalign’s aligner products, without authorization, incorporated patented technologies developed by Align. It seeks an exclusion order to bar the importation of infringing products in the U.S. The company also wants a cease-and-desist order to stop the sale of infringing products already in the U.S. market.

“We are taking the necessary steps through the ITC to protect our patented technologies and significant R&D investments from unlawful importation and use,” said Julie Coletti, EVP, chief legal and regulatory officer. “This ITC action demonstrates our dedication to protecting Align innovation and our unwavering commitment to fair competition. Unlawful trade practices must not be allowed to erode the value of genuine innovation.”

Angelalign previously said it “categorically denies accusations of patent infringement,” and it “promises a vigorous defense.”
