Sameer Wankhede’s defamation suit against Ba***ds Of Bollywood series REJECTED by Delhi HC citing ‘n…
The Court permitted Wankhede to revise the plaint even though it dismissed the present one. The Court ordered that the Registry list the issue when the updated application is submitted; no new hearing date was assigned.
The Delhi High Court on Friday, September 26, dismissed the defamation complaint filed by IRS officer Sameer Wankhede against the Netflix series Ba**ds of Bollywood, stating that the plaint was “not maintainable” in its existing form. Justice Purushaindra Kumar Kaurav heard the case. The complaint lists many defendants, including Red Chillies Entertainment Private Limited, Netflix, X Corp (previously Twitter), Google LLC, Meta Platforms, RPG Lifestyle Media Private Limited, and a John Doe.
Who represented Red Chillies and Netflix?
Senior Advocates Harish Salve and Mukul Rohatgi represented Netflix and Red Chillies Entertainment, respectively, while Senior Advocate Sandeep Sethi represented Wankhede.
What did the court ask Wankhede’s lawyer?
The Court asked Sethi about the cause of action during the hearing, pointing out that the plaint did not specify exactly how a civil suit might be filed in Delhi. Sethi said that the purportedly defamatory memes targeted him in the capital and that the online series was available in locations like Delhi.
The plaintiff’s arguments under Section 9 of the Civil Procedure Code and the particular circumstances in paragraphs 37 and 38, however, were deemed inadequate by the Court.
Case not maintainable without multi-city proof: Delhi HC
The Bench stated that the matter would have been taken into consideration if it had been structured to show defamation that occurred in several locations, including Delhi, with the greatest amount of harm occurring here.
Court asked Wankhede to revise petition
The Court permitted Wankhede to revise the plaint even though it dismissed the present one. The Court ordered that the Registry list the issue when the updated application is submitted; no new hearing date was assigned.
Why Sameer Wankhede filed the suit?
Sameer Wankhede, a former zonal director of the Narcotics Control Bureau (NCB) and an Indian Revenue Service (IRS) official, has filed a defamation lawsuit in the Delhi High Court, requesting an injunction against the Aryan Khan-directed Netflix series Ba***ds of Bollywood. The purpose of the show, according to Wankhede, was to harm his reputation.
