Amazon India unit faces fine for trademark infringement

An Amazon India unit is facing a $39m fine from the Delhi High Court over a trademark infringement case involving Beverly Hills Polo Club (BHPC).
The ruling comes after BHPC trademark owner Lifestyle Equities accused Amazon’s India website of listing apparel with a logo similar to theirs, but at a much lower price point, as reported by Reuters.
The BHPC trademark dispute was initiated in 2020 by Lifestyle Equities.
Citing a court order, the news agency stated that the court found that the infringing brand was owned by Amazon Technologies and sold on the Amazon India online platform.
The court’s 85-page order pointed out that the logo used by the infringing brand was “hardly distinguishable” from that of BHPC.
Issuing a permanent injunction, the court was further quoted by the news agency as saying that Amazon was “well-aware of the exclusive rights of the plaintiffs in the BHPC mark and logo as it has been involved in litigation” in several jurisdictions, including the UK.
In 2019, Amazon encountered similar claims in London from Lifestyle Equities.
In 2024 it lost an appeal challenging a decision that it had violated UK trademarks by marketing to British consumers through its US website.
This legal setback for Amazon follows closely on the heels of a 2024 antitrust investigation in India which found that the company had violated competition laws by favouring certain sellers on its Indian website.
In February 2025, Italian authorities began investigating Amazon, with three senior executives accused of evading €1.2bn ($1.26bn) in taxes.
